1. Introduction
Welcome to The Maidaid India ("Company", "We", "Our", or "Us").
These Terms & Conditions ("Terms") govern your access to and use of our website, mobile platform, customer portal, applications, and all services offered by The Maidaid India.
By accessing our website, submitting an enquiry, creating an account, making any payment, signing a Service Agreement, or availing any service from us, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms & Conditions, our Privacy Policy, Refund Policy, Replacement Policy, and any other policies published by the Company from time to time.
If you do not agree with any part of these Terms, you must immediately discontinue using our website and services.
These Terms constitute a legally binding agreement between you and The Maidaid India under the applicable laws of India.
2. About The Maidaid India
The Maidaid India is a professional domestic staffing and workforce placement company providing verified household staff across India.
Our services include, but are not limited to:
Live-In House Maid
Housekeeping Staff
Cook / Chef
Babysitter & Nanny
Japa Maid
Elder Care Assistant
Patient Care Attendant
Driver
Office Helper
Male Helper
Couple Helper
Domestic Support Staff
The Company provides recruitment, screening, profile verification, interview coordination, documentation assistance, onboarding support, and replacement assistance as per the selected service plan.
Unless expressly agreed in writing, The Maidaid India does not become the employer of the domestic worker. The employment relationship remains directly between the Customer (Employer) and the selected Domestic Worker.
3. Definitions
For the purpose of these Terms:
Company means The Maidaid India and its owners, directors, employees, representatives, affiliates, successors, and assigns.
Customer means any individual, family, organization, company, or institution using our services.
Domestic Worker means any maid, cook, nanny, babysitter, helper, caregiver, patient attendant, driver, or household staff introduced by the Company.
Service Agreement means the written or digital agreement executed between the Customer and the Company.
Website means all websites, mobile applications, customer portals, and digital platforms operated by The Maidaid India.
Booking means the request submitted by the Customer after payment of the applicable registration or service charges.
Service Fee means the professional fee charged by the Company for recruitment, screening, verification, documentation, coordination, onboarding, and replacement services.
Monthly Salary means the salary mutually agreed between the Customer and the Domestic Worker.
4. Eligibility
To use our services, you must:
Be at least 18 years of age.
Be legally competent to enter into a binding contract under Indian law.
Provide true, accurate, and complete information.
Submit valid identity and address proof whenever requested.
Agree to comply with all applicable laws and these Terms & Conditions.
The Company reserves the right to reject, suspend, or terminate any booking if false, misleading, incomplete, or fraudulent information is provided.
5. Acceptance of Terms
By using our website or services, you confirm that:
You have carefully read these Terms.
You voluntarily agree to all policies of the Company.
You understand that service availability depends upon workforce availability.
You understand that worker profiles are provided based on suitability and availability.
You agree that deployment timelines are estimated and may vary due to operational requirements.
You authorize the Company to communicate with you through phone calls, SMS, WhatsApp, email, or other electronic means regarding your booking and services.
The Company may update these Terms from time to time without prior notice. Continued use of our services after such updates shall constitute acceptance of the revised Terms.
6. Website Usage Policy
By accessing or using The Maidaid India website, you agree to use the website only for lawful purposes and in accordance with these Terms & Conditions.
You agree that you shall not:
Use the website for any unlawful, fraudulent, misleading, or unauthorized purpose.
Upload or transmit any harmful software, viruses, malware, or malicious code.
Attempt to gain unauthorized access to our systems, servers, databases, or customer information.
Copy, reproduce, modify, distribute, or commercially exploit any content available on the website without prior written permission from the Company.
Misrepresent your identity or provide false, inaccurate, or misleading information.
Interfere with the proper functioning, security, or performance of the website.
The Company reserves the right to suspend or permanently block access to any user found violating these Terms without prior notice.
7. Customer Registration & Verification
To process a booking, the Customer may be required to provide accurate and complete information, including but not limited to:
Full Name
Mobile Number
Email Address
Residential or Office Address
Government-issued Identity Proof (if required)
Any additional information reasonably requested for verification.
The Customer is solely responsible for ensuring that all information submitted is accurate and up to date.
The Company reserves the right to reject, suspend, or cancel any booking if false, misleading, incomplete, or fraudulent information is provided.
8. Booking Process
The standard booking process includes the following stages:
Customer submits an enquiry through the website, phone, WhatsApp, email, or any authorized communication channel.
Our team understands the Customer's requirements and recommends a suitable service plan.
The Customer completes the registration and pays the applicable booking amount or service charges.
Verified domestic worker profiles are shared based on the Customer's requirements and staff availability.
The Customer may interview the shortlisted candidates before making a selection.
Upon confirmation, the Customer signs the applicable Service Agreement.
The Company coordinates deployment of the selected Domestic Worker within the applicable service timeline.
Submission of a booking request does not guarantee immediate deployment. Deployment is always subject to worker availability, operational feasibility, document verification, and acceptance by both parties.
9. Payment Terms
The Customer agrees to pay all applicable charges as communicated by the Company before commencement of the service.
Payments may include, where applicable:
Registration Charges
Service Charges
Applicable GST
Travel or relocation expenses (if applicable)
Any additional charges mutually agreed in writing.
All payments shall be made only through the payment methods officially approved by The Maidaid India.
The Company does not authorize any employee, consultant, or representative to receive cash or personal payments unless specifically authorized in writing.
Customers are advised to obtain a valid payment receipt for every transaction.
Failure to make payments within the agreed timeline may result in suspension, cancellation, or delay of the booking without any liability on the part of the Company.
10. Taxes (GST)
All service charges are exclusive of applicable Goods and Services Tax (GST), unless expressly stated otherwise.
GST shall be charged at the prevailing rate prescribed under applicable Indian laws.
Once deposited with the Government, the GST component shall not be refundable except where required under applicable law.
Customers are responsible for providing accurate billing details for GST invoices, wherever applicable.
11. Service Activation
The service shall be deemed activated when any one of the following occurs:
A Domestic Worker's joining is confirmed.
The Customer accepts and confirms the selected worker.
The worker reports at the Customer's location.
The Service Agreement comes into effect.
The Company begins deployment activities under the selected service package.
From the date of service activation, all applicable policies, including the Replacement Policy, Cancellation Policy, Refund Policy, and Service Agreement, shall become effective.
12. Worker Selection Process
The Company makes every reasonable effort to recommend suitable candidates based on the Customer's requirements, preferences, experience, skills, language, location, and availability.
However, selection of the final Domestic Worker remains entirely at the Customer's discretion.
The Company does not guarantee that every profile shared will be accepted by the Customer or that every selected worker will ultimately join the assignment.
Operational delays may occur due to document verification, medical issues, travel constraints, personal emergencies, family circumstances, or other unforeseen situations affecting worker availability.
The Company shall not be held liable for such circumstances beyond its reasonable control.
13. Customer Responsibilities
To ensure smooth and uninterrupted service, the Customer agrees to comply with the following responsibilities:
13.1 Safe Working Environment
The Customer shall provide a safe, respectful, and hygienic working environment for the Domestic Worker at all times.
13.2 Accommodation (For Live-In Services)
For Live-In services, the Customer shall provide:
Safe and secure accommodation.
Adequate sleeping space.
Access to clean drinking water.
Proper sanitation and washroom facilities.
13.3 Food
The Customer shall provide reasonable daily meals to the Domestic Worker during the employment period unless otherwise agreed in writing.
13.4 Monthly Salary
The monthly salary shall be paid directly by the Customer to the Domestic Worker on or before the agreed salary date.
The Company is not responsible for collecting, holding, or distributing the worker's monthly salary unless specifically agreed in writing.
13.5 Working Hours
The Customer shall ensure that the Domestic Worker's working hours, weekly rest, emergency duties, and leave are mutually discussed and reasonably managed.
13.6 Respectful Behaviour
The Customer shall not:
Physically assault the worker.
Verbally abuse the worker.
Threaten or intimidate the worker.
Discriminate on the basis of religion, caste, gender, language, or ethnicity.
Force the worker to perform illegal or dangerous activities.
13.7 Identity Verification
The Customer may be required to provide valid identity proof and address proof whenever requested by the Company for security or legal compliance.
13.8 Legal Compliance
The Customer shall comply with all applicable laws while engaging any Domestic Worker through The Maidaid India.
14. Domestic Worker Responsibilities
Every Domestic Worker introduced by the Company is expected to maintain professional conduct throughout the service period.
The Domestic Worker agrees to:
Perform assigned household duties honestly and responsibly.
Follow reasonable instructions given by the Customer.
Maintain cleanliness and discipline.
Respect the privacy and confidentiality of the Customer.
Avoid misconduct, theft, violence, or illegal activities.
Inform the Customer in advance whenever leave is required.
Take proper care of household property entrusted to them.
The Company expects every worker to maintain professional standards; however, day-to-day supervision remains the responsibility of the Customer after deployment.
15. Employment Relationship
The Company acts as a recruitment, screening, and placement service provider.
Unless expressly agreed otherwise in writing:
The Domestic Worker shall be employed directly by the Customer.
The Company shall not be considered the employer of the Domestic Worker.
Salary, leave, bonuses, incentives, overtime, holidays, and daily supervision shall be mutually managed between the Customer and the Domestic Worker.
The Company shall not be liable for employment-related statutory obligations arising after deployment unless specifically agreed under a separate contract.
16. Salary & Other Expenses
The monthly salary of the Domestic Worker shall be mutually agreed upon by the Customer and the Worker before joining.
Unless specifically mentioned in the selected service package, the following expenses shall be borne by the Customer:
Monthly salary.
Food expenses.
Accommodation.
Medical expenses arising during employment (where legally or mutually applicable).
Emergency travel expenses, if mutually agreed.
Festival bonus or gifts (optional unless contractually agreed).
Any salary revision shall be mutually decided between the Customer and the Domestic Worker.
The Company shall not be responsible for disputes relating to salary revisions after deployment.
17. Trial Period
If the selected service package includes a trial or observation period, both the Customer and the Domestic Worker shall cooperate in evaluating suitability.
During this period:
The Customer shall provide reasonable guidance regarding work expectations.
The Domestic Worker shall make sincere efforts to adapt to the household environment.
Minor adjustment issues shall not automatically qualify for cancellation or refund.
Where appropriate, the Company may provide counselling or coordination before initiating a replacement.
The availability and duration of any trial period shall be governed by the selected service plan and Service Agreement.
18. Replacement Policy
The Company is committed to providing replacement assistance in accordance with the selected service package.
A replacement request may be considered under circumstances including, but not limited to:
Voluntary resignation by the Domestic Worker.
Medical unfitness preventing continuation of work.
Verified misconduct.
Repeated unauthorized absence.
Serious behavioural issues.
Safety concerns supported by reasonable evidence.
Unsuitability despite reasonable adjustment efforts.
Replacement requests shall be reviewed by the Company before approval.
The standard replacement timeline is generally between 2 to 15 working days, subject to worker availability, location, verification requirements, travel arrangements, and operational conditions.
The Company reserves the right to investigate the circumstances before approving any replacement request.
Replacement shall not be applicable where:
The Customer violates the Service Agreement.
Salary remains unpaid.
The Domestic Worker leaves due to harassment, abuse, unsafe working conditions, or unlawful demands.
The Customer hires the worker privately outside the agreed service arrangement.
The Customer refuses reasonable replacement options without valid justification.
The exact number of complimentary replacements, replacement validity period, and applicable conditions shall be governed by the Customer's selected service package and Service Agreement.
19. Cancellation Policy
The Customer may request cancellation of the booked service by submitting a written request through the Company's official email address or other authorized communication channels.
Cancellation requests shall become effective only after written acknowledgment by the Company.
The applicable cancellation charges and refund eligibility shall be determined based on:
The stage of the booking process.
Whether a Domestic Worker has already been assigned or deployed.
The selected service package.
The signed Service Agreement.
Any expenses already incurred by the Company.
If the Customer cancels the booking after deployment has been initiated, the Company reserves the right to deduct applicable registration charges, service charges, travel expenses, verification costs, documentation charges, GST, and any other actual expenses incurred.
Verbal cancellation requests shall not be considered valid unless confirmed in writing by the Company.
20. Refund Policy
The Company believes in maintaining a transparent and fair refund process.
Refund eligibility shall be determined strictly in accordance with the selected service package, Service Agreement, and the circumstances of each case.
20.1 Non-Refundable Charges
Unless otherwise agreed in writing, the following amounts are non-refundable:
Registration Charges.
Government taxes including applicable GST already deposited.
Verification expenses.
Documentation charges.
Police verification charges (if applicable).
Travel or relocation expenses already incurred.
Any third-party charges already paid by the Company.
20.2 Refund Eligibility
A refund may be considered only where:
The Company is unable to provide service within the committed timeline under the applicable service package.
The booking is cancelled under circumstances specifically permitting a refund under the signed Service Agreement.
The Company expressly approves the refund after reviewing the case.
Refunds shall not be available merely because the Customer changes their personal preference, no longer requires the service, relocates, or refuses suitable candidates without reasonable justification.
20.3 Refund Processing
Where a refund is approved, it shall be processed through the original mode of payment or any other legally acceptable method determined by the Company.
The standard refund processing period is 45 to 90 working days from the date the refund request is approved, subject to successful verification of all required documents, banking details, and completion of the Company's internal review process.
The Company reserves the right to verify banking details, identity, supporting documents, and any other information reasonably required before releasing any refund.
Delays caused by incomplete documentation, incorrect bank details, third-party banking systems, government holidays, force majeure events, or circumstances beyond the Company's reasonable control may result in an extended processing timeline. In such cases, the Company shall not be held liable for the additional time taken to complete the refund.
21. Limitation of Liability
The Maidaid India acts as a professional recruitment and placement service provider.
To the fullest extent permitted by applicable law, the Company shall not be liable for:
Any act, omission, negligence, misconduct, or criminal activity committed by a Domestic Worker after deployment.
Loss of business, income, profits, reputation, or indirect damages.
Disputes arising between the Customer and the Domestic Worker after employment commences.
Personal disagreements, compatibility issues, or lifestyle differences.
Property loss or damage unless directly caused by the Company's proven negligence.
Delays caused by travel restrictions, medical emergencies, natural disasters, government actions, or other events beyond the Company's reasonable control.
The Company's maximum liability, if any, shall in no event exceed the total professional service fee actually received by the Company for the specific booking giving rise to the claim.
22. Customer Acknowledgement
The Customer expressly understands and agrees that:
Selection of the Domestic Worker is made by the Customer.
Household supervision remains entirely with the Customer after deployment.
The Company cannot guarantee the future behaviour, performance, personal compatibility, or continued availability of any Domestic Worker.
Every Domestic Worker is an independent individual and retains the right to resign or discontinue employment in accordance with applicable law and the Service Agreement.
The Customer further acknowledges that no oral promise, verbal assurance, or unofficial communication shall override the written Service Agreement or these Terms & Conditions.
23. Privacy & Data Protection
The Company values the privacy of its Customers and Domestic Workers.
Personal information collected through the website or during the booking process may include:
Name
Contact details
Address
Identity documents
Payment information
Communication records
Service preferences
Such information shall be used only for purposes including:
Customer verification
Worker matching
Service delivery
Legal compliance
Billing
Customer support
Quality assurance
Internal business operations
The Company shall take reasonable administrative, technical, and organizational measures to protect personal information.
However, no electronic storage or internet transmission can be guaranteed to be completely secure, and the Company shall not be liable for unauthorized access beyond its reasonable control.
24. Intellectual Property Rights
All content available on the Company's website, including but not limited to:
Logos
Brand names
Trade names
Designs
Graphics
Icons
Text
Images
Videos
Documents
Software
Website layout
Marketing materials
Are the exclusive property of The Maidaid India or its respective licensors and are protected under applicable intellectual property laws.
No person shall copy, reproduce, modify, publish, distribute, transmit, sell, license, or commercially exploit any content without prior written permission from the Company.
Unauthorized use of the Company's intellectual property may result in civil and criminal legal proceedings.
25. Confidentiality
The Customer and the Company agree to maintain the confidentiality of all information exchanged during the course of the service.
Neither party shall disclose any confidential information, including but not limited to:
Personal identity details
Contact information
Residential addresses
Financial information
Internal documents
Service agreements
Pricing structures
Business processes
Worker profiles
Customer records
Such information shall not be shared with any third party except:
Where required by applicable law;
With the prior written consent of the concerned party; or
For the purpose of providing or improving the Company's services.
This obligation shall survive even after the completion or termination of the service.
26. Website Disclaimer
The information available on this website is provided for general informational purposes only.
While The Maidaid India makes every reasonable effort to ensure that the information published on the website is accurate and up to date, the Company does not warrant or guarantee:
Continuous availability of the website;
Accuracy or completeness of all information;
Availability of any specific domestic worker;
Error-free operation of the website;
Compatibility between a Customer and a Domestic Worker.
Profiles, photographs, descriptions, experience, qualifications, and other information are based on documents, declarations, and information received during the verification process. Although reasonable screening is conducted, the Company cannot guarantee that every detail will remain accurate or unchanged after publication.
Customers are advised to conduct their own interviews and satisfy themselves before final selection.
27. Force Majeure
The Company shall not be liable for any delay, interruption, suspension, or failure in providing services due to circumstances beyond its reasonable control, including but not limited to:
Natural disasters
Floods
Earthquakes
Fire
Pandemic or epidemic
Government restrictions
War or civil unrest
Labour strikes
Transportation disruptions
Internet or communication failures
Power outages
Court orders
Acts of God
Any other unforeseen event beyond the Company's control.
During such events, the Company's obligations shall remain suspended until normal operations reasonably resume.
28. Termination of Services
The Company reserves the right to suspend or terminate any booking, account, or service without prior notice if:
The Customer violates these Terms & Conditions;
False or misleading information has been provided;
Payment obligations are not fulfilled;
Any employee, representative, or Domestic Worker is subjected to abuse, harassment, threats, or unlawful conduct;
Fraudulent or illegal activity is suspected;
The Company's reputation, staff, or business interests are adversely affected.
Termination of service shall not affect any rights or obligations accrued before the date of termination.
29. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of India.
Any dispute arising out of or relating to these Terms, the Service Agreement, or the services provided by The Maidaid India shall be subject to the exclusive jurisdiction of the competent courts located at Jamshedpur, Jharkhand, India, unless otherwise agreed in writing.
30. Dispute Resolution
Before initiating any legal proceedings, both parties agree to make reasonable efforts to resolve disputes amicably through discussion and mutual negotiation.
If the dispute cannot be resolved amicably within a reasonable period, the parties may proceed in accordance with the applicable laws of India before the competent courts having jurisdiction.
Nothing contained herein shall prevent the Company from seeking urgent legal or equitable relief wherever necessary to protect its rights.
31. Amendments
The Company reserves the right to modify, update, revise, or replace these Terms & Conditions at any time.
The revised Terms shall become effective immediately upon publication on the official website unless otherwise stated.
Continued use of the website or services after such publication shall constitute acceptance of the revised Terms.

The Customer is responsible for ensuring that the contact details provided are accurate and up to date.
Any notice sent to the last registered contact details shall be deemed to have been duly delivered.
33. Severability
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to remain valid and enforceable to the fullest extent permitted by law.
34. Waiver
Failure by the Company to enforce any provision of these Terms & Conditions shall not constitute a waiver of that provision or any other rights available to the Company.
No waiver shall be effective unless made in writing and signed by an authorized representative of the Company.
35. Entire Agreement
These Terms & Conditions, together with the Privacy Policy, Refund Policy, Replacement Policy, Service Agreement, and any other written policies published by The Maidaid India, constitute the complete agreement between the Customer and the Company.
They supersede all previous oral discussions, representations, understandings, advertisements, proposals, or communications relating to the services.

37. Acceptance
By accessing the Company's website, submitting an enquiry, communicating through the Company's official channels (including WhatsApp, email, SMS, or telephone), accepting any quotation, invoice, or Service Agreement, making any payment, or availing any service offered by The Maidaid India, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms & Conditions and all applicable Company policies.
Any confirmation, approval, consent, or instruction provided through the Company's official communication channels, including WhatsApp messages, emails, electronic communications, payment confirmations, or recorded telephone conversations (where legally permissible), shall be treated as valid acceptance to the extent permitted under applicable laws of India.
If you do not agree with these Terms & Conditions, you must discontinue the use of the Company's website and services immediately.
